Approved refunds or transfers remain entirely at the discretion of KX Pilates Thailand and may be subject to administrative fees. Where a refund is approved after classes have been attended, used sessions may be deducted at the applicable casual class rate.
Cancellations & Rescheduling
As KX Pilates classes are intentionally limited in size, each booking reserves a dedicated reformer and place within the class. We kindly ask clients to review the following policies to ensure availability can be managed fairly for all members of the KX community. Advance Cancellation Bookings may be cancelled up to nine (9) hours before the scheduled class start time.
Where notice is provided within the required timeframe, the class credit will be returned to the client's account for future use.
Late Cancellation
Cancellations made within nine (9) hours of the scheduled class start time will be considered a late cancellation.
As the reserved place may no longer be offered to another client at short notice, the class credit will be treated as attended and cannot be refunded, transferred, or reinstated.
Rescheduling
Bookings may be moved to another available class outside the nine (9) hour cancellation window.
Rescheduling requests made within nine (9) hours of class commencement cannot be accommodated and will be treated as a late cancellation.
No Show
If a client does not attend a booked class and has not cancelled their reservation, the booking will be recorded as a no-show.
As the reserved place has been exclusively held and remains unavailable to other clients, the class credit will be forfeited and cannot be refunded, transferred, or reinstated.
Notification
All cancellations and rescheduling requests must be made through the booking system prior to the commencement of class.
Messages sent after a class has commenced cannot be accommodated.
Waitlists
Clients may join a waitlist for fully booked classes. If a place becomes available, the next eligible client on the waitlist will be notified via email and/or the KX Pilates app. The notified client will have up to two (2) hours to accept the available place. If the place is not accepted within that time, the offer may be released to the next client on the waitlist. Waitlist notifications may be sent at any time, including outside of standard business hours. It is the client's responsibility to ensure their contact information and notification settings are up to date and to monitor waitlist communications. Acceptance of a waitlisted place constitutes a confirmed booking and becomes subject to KX Pilates Thailand's standard cancellation and late cancellation policies.
Late Arrival Policy
To ensure a safe and seamless experience for all participants, we recommend arriving 10-15 minutes before your scheduled class. New Clients
Clients attending KX Pilates Thailand for the first time should arrive at least 10-15 minutes prior to class commencement. This allows our team to:
Introduce you to the studio;
Explain the KXFormer equipment;
Review injuries and medical considerations;
Familiarise you with class expectations and safety procedures.
Late Entry Entry will not be permitted for clients arriving more than ten (10) minutes after the scheduled class start time. The opening portion of class includes instructor-led preparation, movement education, and warm-up exercises that are essential for safe participation. Late entry may increase the risk of injury and disrupt the experience of other clients. Where entry is refused due to late arrival, the booking will be treated as a late cancellation and the class credit will be forfeited.
Grip Socks Requirement
Grip socks must be worn during all classes.
Clients without grip socks may purchase approved grip socks from the studio. Participation without grip socks is not permitted for hygiene and safety reasons. Outdoor footwear must be removed before entering the studio floor.
Studio Etiquette
Clients agree to:
Follow instructor directions at all times;
Use equipment safely and appropriately;
Treat staff and fellow clients with courtesy and respect;
Refrain from disruptive, abusive, threatening, or inappropriate behaviour.
KX Pilates Thailand reserves the right to refuse service, remove a participant from class, or terminate memberships where behaviour is deemed inappropriate.
Photography & Filming
We understand many clients enjoy documenting and sharing their KX experience. To maintain a respectful and comfortable environment for all participants, photography and filming must not:
Include other clients without their consent;
Disrupt instruction;
Delay the commencement of class;
Interfere with the safe use of equipment.
The privacy, comfort, and wellbeing of all participants will always take priority over content creation. KX Pilates Thailand reserves the right to request that photography or filming be limited or discontinued at any time. KX Pilates Thailand may occasionally capture photographs or videos for marketing purposes. Clients who do not wish to appear in promotional content should notify the studio prior to class.
Personal Property
Clients are responsible for their own personal belongings. KX Pilates Thailand accepts no responsibility for the loss, theft, or damage of personal property brought into the studio.
Emergency Exceptions
We understand that genuine emergencies may occasionally arise. In circumstances involving sudden illness, accidents, medical emergencies, or unforeseen personal events, exceptions to these policies may be considered at the sole discretion of KX Pilates Thailand.
Clients should notify the studio as soon as reasonably possible. Supporting documentation may be requested where appropriate. Emergency exceptions are intended for rare and unforeseen circumstances and do not apply to scheduling conflicts, work commitments, traffic delays, travel plans, or repeated cancellations.
Limitation of Liability
To the fullest extent permitted by law, KX Pilates Thailand shall not be liable for:
Personal injury arising from participation in classes;
Loss or damage to personal property;
Indirect, incidental, or consequential losses.
The exclusions above do not apply, and KX Pilates Thailand remains liable, to the extent that any loss or injury arises from the gross negligence or wilful misconduct of KX Pilates Thailand or its staff, or as otherwise cannot be lawfully excluded under Section 373 of the Thai Civil and Commercial Code or other applicable Thai law. Nothing in these Terms & Conditions excludes any rights that cannot be excluded under applicable Thai law. Clients acknowledge that participation in reformer Pilates and related activities involves inherent physical risks. Clients are responsible for exercising within their own ability, following instructor guidance, and immediately stopping participation if they feel pain, dizziness, discomfort, or any unusual symptoms.
This acknowledgment is provided in addition to, and does not limit or replace, the health and medical acknowledgments set out in Clause 3 (Health & Medical Conditions).
Privacy
KX Pilates Thailand collects, stores, and processes personal information for operational, booking, payment, customer service, and marketing purposes. Such processing is carried out on the basis of contractual necessity, compliance with legal obligations, KX Pilates Thailand's legitimate interests, or the client's consent, as applicable, in accordance with the PDPA. Personal information will be handled in accordance with applicable Thai privacy legislation and our Privacy Policy. Where applicable, personal data will be handled in accordance with the Personal Data Protection Act B.E. 2562 (PDPA). Clients may request access to, correction of, deletion of, restriction of, or withdrawal of consent for the processing of their personal data, subject to applicable legal grounds and operational requirements. Requests relating to personal data should be submitted to KX Pilates Thailand through the official contact channels provided by the studio. KX Pilates Thailand will endeavour to respond to such requests within a reasonable time, and in any event within the timeframe prescribed under the PDPA and its subordinate regulations, subject to any extension permitted by law.
Website Use
Users agree not to misuse the website, interfere with its operation, or attempt unauthorized access to systems or data. All content, trademarks, branding, images, and materials displayed on the website remain the intellectual property of KX Pilates Thailand or its licensors.
Force Majeure
KX Pilates Thailand shall not be liable for delays, cancellations, or inability to provide services due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, government restrictions, utility failures, labour disputes, or other force majeure events. Where a force majeure event prevents a client from using a membership or class pack for a continuous period of more than seven (7) days, KX Pilates Thailand will, where reasonably practicable, notify affected clients and extend the applicable validity period, or the minimum commitment or pause period under Clause 7, by a period equivalent to the duration of the event.
Changes to Terms & Conditions
KX Pilates Thailand reserves the right to amend these Terms & Conditions at any time. Updated versions will be published on our website and become effective immediately upon publication. Where an amendment materially and adversely affects an existing member's rights under a membership or class pack already purchased, the amendment will take effect no earlier than the start of that client's next billing cycle, or after the reasonable notice period referred to in Clause 9, whichever is later.
Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Kingdom of Thailand.
Any disputes arising from these Terms & Conditions shall be subject to the jurisdiction of the courts of Thailand.
